Terms and Conditions of Trading H J Cooper Limited

These Terms and Conditions of Trading apply to all consumer contracts (written invoice) between H J Cooper Limited (us/we/our) and the Customer (you/your) in relation to sales of goods and services.

1. Product Specifications
1.1 It is your responsibility to ensure that the furniture ordered, as specified on our invoice, will pass freely into your room of choice. If you are in any doubt, we can arrange to have the accessibility of your room of choice checked. If necessary, we can manufacture most designs in sections or with bolt-on arms, at a small additional cost.
1.2 The measurements of all furniture and furnishings made by us will be as accurate as possible, but are, nevertheless, approximate.
2. Prices
2.1 All prices are inclusive of VAT at the prevailing rate. Promotional and Sale prices are extended for the limited period stated, and not available outside of these dates.
3. Payments
3.1 We will require an initial deposit at point of order, which is non-refundable once order has been progressed.
3.2 The contract between H J Cooper Limited and the Customer will not be considered closed until we have received full payment, which may be made by Credit/Debit Card, Cash, Cheque or on-line transfer. Full or balancing payment will be required before or on delivery.
4. Delivery
4.1 Our Standard Delivery is usually carried out on a Saturday, by a two-man team. We will deliver into your room of choice (see 1.1 above), remove all packaging and fix sections/bolt-on arms, if necessary.
4.2 As specified in 1.1 above, it is your responsibility to ensure that the items ordered will pass freely into the room of choice. If there is a requirement to remove doors, windows or other fixtures, an additional charge will be levied.
4.3 Any changes or alterations made to your order by you may incur additional cost, and will impact on the deliver date.
4.4 You must ensure that there is safe and reasonable access from the public highway to your premises. If our delivery team considers that it is otherwise, the items will not be delivered until it is safe to do so. If parking permits are required, we request that these are provided by you, in advance.
4.5 We will provide a 90-minute time slot for delivery. However, we will not accept liability for any loss incurred by you through any reasonable delay outside our control.
5. Guarantees
5.1 The furniture illustrated in this website carries a 10-year guarantee against faulty workmanship and/or faulty materials, with the exception of fillings and coverings.
5.2 These guarantees are not transferable.
5.3 These guarantees exclude: fair wear and tear, neglect, abuse or misuse, loss or damage due to water, heat or weather, loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by mammals or insects, theft, or accidental damage/loss caused by a third party.
6. Returns/Alterations
6.1 You may alter your order, in writing, within the first seven days following invoice, but your deposit may be retained to cover any costs incurred by us in progressing your order (see 3.1).
6.2 Any furniture ordered by you that has been ‘customised’ (i.e. special size, colour, shape, etc), may not be returned or refunded. This does not affect your statutory rights.
7. Content Accuracy
7.1 Every effort has been made to ensure the accuracy of our website. However, some details and prices may change from time to time, and we ask that you check prior to placing your order. We accept no liability for any loss incurred by you due to your failure to do this.
8. Other Services
8.1 Fabric protector. We offer “PremierCare” Fabric Protection, by the Castelan Group, at additional cost. Please enquire at time of ordering. Separate Terms and Conditions apply.
8.2 H J Cooper Limited hold a Consumer Credit Licence with the Office of Fair Trading (OFT), and offer Interest Free Credit, subject to certain conditions. This is regulated by Financial Conduct Authority (FCA) and governed by UK Law.

These Terms and Conditions or Trading are governed by, and are to be construed in accordance with, the laws of England and Wales. They do not affect your statutory rights.
